1. Definitions
"We", "Us", "Our" refers to Kiwis Across The Ditch – Relocation Services.
"Client" refers to the individual or entity engaging our services.
"Service" refers to attending rental property inspections and providing feedback on behalf of the Client.
2. Scope of Services
2.1 We attend rental property inspections on behalf of the Client when the Client is unable to attend in person.
2.2 We provide general observations, photos, videos, and written or verbal feedback based on visible conditions at the time of inspection.
2.3 We do not:
Provide legal, financial, building, pest, or tenancy advice
Negotiate rental terms unless agreed in writing
Guarantee the condition, availability, or suitability of any property
Influence approval decisions by landlords or agents
3. No Guarantee of Rental Outcome
3.1 We do not guarantee:
Successful rental applications
Approval by landlords or property managers
Availability of properties at the time of inspection 3.2 All rental decisions are made solely by third parties.
4. Visual Inspection Disclaimer
4.1 Inspections are visual only and non-invasive.
4.2 We do not inspect or test:
Plumbing, electrical, gas, appliances, or utilities
Structural integrity
Pest activity, mould, or environmental hazards 4.3 Property conditions may change after the inspection date.
5. Client Responsibility
5.1 The Client acknowledges that all feedback provided is general information only.
5.2 The Client accepts full responsibility for rental decisions, applications, and lease agreements.
5.3 We strongly recommend Clients conduct their own due diligence before entering into any tenancy agreement.
6. Fees, Packages & Payment
6.1 We offer relocation service packages that include up to eight (8) property viewings within a defined service period.
6.2 The package fee covers availability, scheduling, coordination, travel, and attendance at inspections.
6.3 Payment is required in advance unless otherwise agreed in writing.
6.4 Additional fees may apply for urgent bookings, extended inspections, or travel outside standard service areas.
6A. Package Inclusions & Unused Viewings
6A.1 Packages are time-based and valid for 30 days from the commencement date unless otherwise agreed in writing.
6A.2 Unused viewings do not carry over beyond the service period and do not qualify for a refund or partial refund.
6A.3 Refunds for unused viewings are only applicable where we are unable to deliver the service due to our own cancellation or unavailability.
6A.4 Where a Client secures a property early or chooses not to use all available viewings, the package is deemed fulfilled.
6A.5 At our discretion, unused viewings may be converted to a service credit valid for 60 days.
7. Cancellations & Refunds
7.1 No refunds are provided if:
The service begins by viewings. You may request a refund within 24hours after payment if viewings have not yet begun.
The real estate agent cancels or fails to attend
The Client fails to provide correct application details
Refunds, if approved, are at our discretion.
8. Limitation of Liability
8.1 To the maximum extent permitted by law, our liability is limited to the amount paid for the Service.
8.2 We are not liable for:
Hidden or future defects
Loss of opportunity or rental income
Decisions made by third parties
Reliance on information provided
9. Third-Party Relationships
9.1 We are independent of landlords, property managers, and real estate agencies.
9.2 We are not responsible for inaccuracies in listings or representations made by third parties.
10. Privacy & Confidentiality
10.1 Personal information is handled in accordance with the Privacy Act 1988 (Cth).
10.2 Information is used solely to provide services and will not be shared except where required to fulfil the Service.
11. Intellectual Property
11.1 All photos, videos, and reports remain our intellectual property unless otherwise agreed.
11.2 Clients may use provided content for personal relocation purposes only.
12. Force Majeure
We are not liable for failure or delay caused by events beyond our control, including weather, illness, transport disruptions, or emergencies.
13. Governing Law
These Terms & Conditions are governed by the laws of the Australian state or territory where the Service is provided.
14. Acceptance of Terms
By booking, paying for, or using our services, the Client confirms acceptance of these Terms & Conditions.
